I saw a Tweet last week that referred to Gardasil as Merck’s “Help Pay for Vioxx” Hail Mary pass. Vioxx was a painkiller that resulted in lawsuits that cost Merck almost $4 billion dollars. Most Americans are aware that when a drug harms or kills, the consumer has rights, including the right to sue for wrongful death or injury. Most are unaware that this is not so with vaccines, which are exempt from liability except in a tightly administered Federal court.
